GOOD NEWS FOR SOME WHO MAY HAVE BEEN DENIED FULL MEDICAID IN FL OR OTHER STATES: IRS 2015 LEGAL RULING MAY ENTITLE YOU THROUGH RE: BENEFITS FORM 1095B
1. For those who have not been made aware that they might be being denied full Medicaid because of poorly trained workers in the system (even major supervisors), and uninformed re: online or in-person reapplication for benefits, have mistakenly/unknowingly opted in for the poorly-defined and -explained “Share of Cost” pool which can deny your claims:
2. Please note that if you have received an IRS form called 1095B from the Agency for Health Care Administration, you automatically qualify for FULL MEDICAID. Keep this paper close at hand and have copies everywhere. Use this form whenever some bureaucrat claims you do not have full Medicaid; you do not need a plastic “gold card” if you present this government-generated IRS form. Also download the first three pages regarding this legal right on the IRS website; present both form 1095B plus IRS Medicaid info pages. Someone I know dedicated eight years of his life through researching his rights online and then took his own pro se case through state court all the way to the SUPREME COURT; HE WON FOR ALL OF US. It is said that HHS Director Kathleen Sibelius was let go because she did not implement and oversee the vital right of DATA EXCHANGE PROCESS between the state and Federal levels for those receiving state and Federal benefits. Without said data exchange process being fully implemented, and formerly it was not, state agencies weren’t giving full or clear info on their application forms, and not able to educate applicants on this life-saving process; many applying got wrongly placed in the sketchy “Share of Cost” category or denied benefits altogether, having to meet nearly impossible monthly standards for help.
3. From his legal action, the 1095B IRS statements began to be generated in 2015; both the Federal and state programs are legally bound to send these out yearly. This case originated in Florida, though the results are beneficial for all US citizens with public disability benefit issues.
